Acceptable use policy

This policy forms an integral part of the terms and conditions. It describes what you may and may not do with Techtuel. Techtuel is a tool: it transcribes what you submit, without checking your rights over that content. That verification is yours to make, and this policy sets out its scope.
1. Rights over submitted content
You warrant that you hold the rights required for every media file you submit for transcription: either because you are its author or rightsholder, or because you have authorisation, or because your use falls under a statutory copyright exception.
You must not submit:
- content protected by copyright, a neighbouring right, a trademark or a trade secret, without the rightsholder's prior authorisation;
- content whose transcription is intended to enable its republication, resale or distribution in breach of its author's rights;
- content obtained through unauthorised access (circumventing a paywall, DRM or access restriction).
The transcripts produced from your media belong to you. That ownership extends only as far as the rights you held over the original media: transcribing a work grants you no rights over it.
2. Third-party platform terms
Techtuel can transcribe a media file identified by its URL, including from video and podcast platforms. You are responsible for complying with those platforms' terms of service.
In particular, YouTube's terms restrict automated extraction of content. Using Techtuel on a source whose terms forbid it breaches this policy, and you alone are answerable to the platform concerned.
You must not use the service to circumvent a technical protection measure, an access restriction or an anti-bot mechanism put in place by a third party.
3. Personal data within media
A recording often contains the voice, name or details of people who are not you: meeting participants, interviewees, guests. Those people have rights over that data.
When you submit media containing third parties' personal data, you act as data controller and warrant that you have a legal basis within the meaning of article 6 GDPR, and that you have informed the data subjects where the law requires it.
You must not submit:
- a recording made without the knowledge of the people concerned where their consent or information was required;
- a recording obtained unlawfully (an intercepted private communication, an undeclared surveillance device);
- special-category data within the meaning of article 9 GDPR (health, political opinions, religion, sexual orientation, biometric data) without a specific legal basis.
If you process third parties' personal data in a professional capacity, a data processing agreement governs our role.
4. Prohibited uses
Irrespective of your rights over the content, you must not use Techtuel to:
- produce or distribute unlawful content: incitement to hatred or violence, child sexual abuse material, glorification of terrorism, defamation, harassment;
- monitor a person without their knowledge, or build a profile from their statements without a legal basis;
- circumvent the service's quotas: creating multiple accounts, sharing or reselling API keys, automating repeated free trials;
- resell or redistribute the service as such, or embed it in a competing offering, without prior written agreement;
- disrupt the infrastructure: abnormal volumes, intrusion attempts, reverse engineering, unauthorised load testing;
- carry out any activity contrary to applicable law or to a third party's rights.
5. Consequences of a breach
Where this policy is breached, we may suspend or terminate your access — without notice where the seriousness or urgency warrants it — and without refunding sums already paid or credits left unused.
We do not monitor the content of your transcripts and are under no general obligation to do so. We act on report, or when our technical safeguards detect abnormal use.
If a third party brings a claim against us arising from your content or your use of the service, you indemnify us on the terms set out in the « Your obligations and warranty » article of the terms and conditions.
6. Reporting
To report abuse of the service or unlawful content produced through it, write to abus@techtuel.com or use the contact form. Please give the URL or identifier concerned and the nature of the problem.
7. Changes
This policy may change as the service evolves. Any substantial change will be notified to you by e-mail at least thirty days before it takes effect. Continuing to use the service after that date constitutes acceptance.
